General Terms and Conditions of GVS Austria e. U. for the purchase and sale of rare earths and strategic metals.

Subsequent the GVS Austria e.U. will also be called "Rare-Earths.at"

All offers of Rare-Earths.at are without commitment and subject to change without notice. Orders are valid after receiving the acceptance of order, the commercial invoice or the actual completion of the order. The GVS Bullion Group reserves the right to decline orders.

All prices are offered by Rare-Earths.at based on the development of rates on the commodity market and include delivery to an industrial warehouse, tax-free in Busan / South Korea; the customer may freely dispose of the purchased metals. According to customer requirements rare-earths.at also organizes transport and storage at other industrial warehouses in Rotterdam and Singapore. All prices are subject to the circumstances at the time of the conclusion of the agreement.

The customer is bound to arrange payment immediately after the order. Delay of payment is the case if payment does not arrive at Rare-Earths.at after three working days after date of order. In the case of payment delay, Rare-Earths.at can resign from the contract. All of the costs including interest for delay and losses due to price fluctuations will be claimed from the customer.

If the customer decides to store the rare earths/strategic metals himself, the risk passes to the customer at the latest when the products are collected by the customer or a person commissioned by the customer, and also when the products are delivered to the address specified by the customer. At the time of acceptance of the shipment the buyer or the receiver has to control the intactness of the delivery and the sealing. In case of any faults the consignee has to get an affirmation from the deliverer in written form. Incomplete or lost shipments have to be reported immediately..

Orders for rare earths and strategic metals, Section 8 of the German Remote and Away Transactions Act (Fern- und Auswärtsgeschäfte-Gesetz) stipulates that "The consumer has no right of withdrawal in the case of contracts for goods or services concluded at a distance or away from business premises, the price of which depends on fluctuations on the financial market over which the trader has no influence and which may occur within the withdrawal period," Section 8, paragraph 1, line 2 of the German Remote and Away Transactions Act (Fern- und Auswärtsgeschäfte-Gesetz) states.

Rare-earths.at declares to use the data collected by it exclusively for its own purposes, to pass them on to third parties exclusively for the purpose of order processing, for example dispatch, and to treat them confidentially and in compliance with all existing and future data protection regulations.
